Over the past 10 years, the Court system has become much more user friendly and there are some things that litigants can do on their own. However, it has been our experience that so many areas of family law are complicated and require good legal representation. We offer a no-charge initial consultation so if you are unsure, please call and meet one of our lawyers for some good sound advice.

That is our most common question. But the simple answer is that very few divorces are “simple”. It is really only simple if the parties have no matrimonial property and no children. But those cases are extremely rare. We are happy to meet with you and discuss our very reasonable fees and, if your family matter is truly “simple”, we promise a very fair and reasonable fee.

Of course not. We are happy to listen and offer practical advice during our first no-charge consultation. If time is of the essence and you wish to proceed with your divorce quickly and efficiently, bringing a copy of your marriage certificate and a photo of your spouse for service identification would be a useful start. If you and your spouse have children 16 years old or under, you must also take the mandatory Parenting After Separation course. It is a free 6 hour course taught at the Courthouse. To book the course, call (780) 413-9805. You must keep and provide your lawyer with the certificate of completion after you have taken the course.

You don’t have to pay any fees. Our fees are based on a percentage of the total amount of damages settled or collected on your behalf.

In Alberta, there is currently a cap on whiplash related injuries. However, that does not necessarily mean that your injury will fall entirely under the Alberta injury cap. Yes, of course both parties can use the same lawyer. But they must both agree to do so and both must agree that if they have any conflict, both must seek separate legal counsel. We do offer discounted rates where both parties use Kiriak Law Offices.

Assuming you have already selected a qualified realtor, the most common issue that comes up for sellers is having a current Real Property Report. If your report is old, it may still be good so long as there has been no changes to your property, like a deck or shed being constructed. If you don’t have one and don’t want to pay for one, then you will have to get the buyer to agree to Title Insurance in lieu of a Real Property Report. The cost of obtaining a report is approximately $400.00 to $500.00 (plus $102.00 for the City of Edmonton compliance certificate) and takes anywhere from a few days to a few weeks to obtain from a certified Alberta Land Surveyor. The cost of Title Insurance is a little bit less expensive.
